Messageboard rules

These rules govern activity on COYS. In using this site, you agree to be bound by them.

• 1 Your registration obligations
o 1.1 In consideration of your use of COYS, you agree to:-
1.1.1 provide true, accurate, current and complete information about yourself when filling out our registration form; and
1.1.2 maintain and promptly update your registration data (including email address) to keep it true, accurate, current and complete. If we have reasonable grounds to suspect that any information is untrue, inaccurate, not current or incomplete, we may decide to suspend or terminate your registration.
o 1.2 Your display name will be used to identify you. Have fun with your display name by all means but vulgar, offensive or inappropriate display names will constitute a breach of these rules.
o 1.3 If you are offended by another user's display name, please e-mail us at admin@comeonyouspurs.com immediately. Similarly if you are unsure about whether a username you would like to use may breach these rules, e-mail admin@comeonyouspurs.com for advice.
o 1.4 We are concerned about the safety and privacy of all our users, particularly any minors who may be accessing the site. Please remember that our messageboard is designed to appeal to a broad audience. Accordingly, it is your responsibility to determine whether any use of the messageboard is appropriate for a minor. Please also see paragraph 3 in respect of potentially offensive Content.
o 1.5 Access to this website is strictly prohibited to those aged under 16 years old.

• 2 Privacy policy
o 2.1 By agreeing to these rules, submitting your registration information and submitting any other information through posting on COYS, you agree that COYS is a private site and that all data posted on or within the site or contained in your registration information is solely owned by the site owner.
o 2.2 If we change our privacy policy, we will post the changes within these rules and may place notices on other pages of the website, so that you may be aware of the information we collect and how we use it at all times. Continued use of the service will signify that you agree to any such changes.
o 2.3 The internet is not a secure medium. However we have put in place various security procedures to protect the information that you provide.
o 2.3 For those accessing the site from within the European Economic Area, you should be aware that the information you provide will be stored in our servers in the United States of America and, owing to the global nature of the Internet infrastructure, the information you provide may be transferred in transit to countries outside the European Economic Area that do not have similar protections in place regarding your data and its use as set out in this policy. By submitting your information you consent to these transfers.

• 3 On-line conduct
o 3.1 You understand that all data, text, software, music, sound, photographs, graphics, video, messages or other materials ('Content'), whether publicly posted or privately transmitted, are the sole responsibility of the person from which the Content originated. This means that you, and not COYS or its subsidiaries, affiliates, employees, officers, Moderators, agents or partners, are entirely responsible for all Content that you upload, post or e-mail. We do not control the Content posted and therefore do not guarantee the accuracy, integrity or quality of the Content.
o 3.2 Under no circumstances will we be liable in any way for any Content, including (without limitation) any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of your use of any Content. You agree that you must evaluate and bear all risks associated with the use of any Content including any reliance on its accuracy or completeness. You also understand that by using our site, you may be exposed to Content that is offensive to you.
o 3.3 You agree that you will not use COYS or any of its forums to:
3.3.1 upload, post or e-mail any Content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libellous, invasive of another's privacy, deliberately inflammatory, hateful, or racially, ethnically or otherwise objectionable;
3.3.2 harm minors in any way;
3.3.3 impersonate any person or entity, falsely state or otherwise misrepresent your affiliation with a person or entity or disguise the origin of any Content;
3.3.4 'stalk' or otherwise harass any other user;
3.3.5 collect or store personal data about other users;
3.3.6 upload, post or e-mail any Content that you do not have a right to transmit under any law or under contractual or fiduciary relationships;
3.3.7 upload, post or e-mail any Content that infringes any intellectual property rights of any party;
3.3.8 upload, post or e-mail any unsolicited or unauthorised advertising, promotional materials, 'junk mail', 'spam', 'chain letters', or any other form of solicitation;
3.3.9 upload, post or e-mail any Content that contains computer viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software, hardware or telecommunications equipment;
3.3.10 disrupt the normal flow of dialogue or otherwise act in a manner that negatively affects other users' ability to engage in discussion;
3.3.11 violate any applicable national or international laws or regulations; or
3.3.12 sell or advertise for sale any items without first obtaining written permission of the COYS Admin. A request for permission should be sent to admin@comeonyouspurs.com. Where permission is given, we ask that you consider making an appropriate donation to the running costs of COYS, to reflect the benefit gained.
o 3.4 You acknowledge that we do not pre-screen Content but that we shall have the right (though not the obligation) in our sole discretion to move, modify or remove any Content.
o 3.5 You acknowledge and accept that the nature of the Internet means that your use of this website may put your computer at risk of being infected by a computer virus, worm, cookie or other manner of electronic program which may impair or destroy the working of your computer and any data held in it and you therefore agree that your use of COYS is entirely at your own risk.
o 3.6 Without prejudice to the generality of these rules, you agree to:
3.6.1 comply with any rules and guidance which may be published from time to time on the forum by the board administrators, the Moderating Team and those assisting them, which may include codes of conduct for the behaviour of forum members whether during their access of this website or at other times. In particular, you agree to comply not only with the letter of those rules and guidance but also with their spirit and intention.
3.6.2 comply with, and respond promptly and courteously to, any instructions or requests made to you by the board administrators, the Moderating Team and those assisting them.

• 4 Copyright
o You grant to us a world-wide, royalty-free, irrevocable, non-exclusive licence (including the right to sub-license) to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display any Content (in whole or part) you upload, post or e-mail and/or to incorporate such Content in other works in any form, media or technology now known or developed.
o You agree not to infringe the copyright of this website or of any other user of this website, nor to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display any material in respect of which the intellectual property belongs to others for any purpose other than the viewing of Content through this website.

• 5 Indemnity
o You agree to indemnify and hold us and our subsidiaries, affiliates, employees, officers, Moderators, agents or partners harmless from and against any direct or indirect loss or damage (including consequential loss and loss of profits, goodwill or business opportunities) arising from any third party claim in relation to any Content you upload, post or e-mail on or through COYS, your use of COYS, or your breach of any of the provisions of these rules.

• 6 Sanctions
o 6.1 As soon as we are made aware of activities that breach these rules, our terms and conditions or our privacy policy, we will endeavour (but without obligation) to take prompt action. If you witness such breaches, please notify the Moderating Team through the Report function immediately.
o 6.2 On being made aware of any such breaches, we may ban, delete or prohibit any Content that relates to those breaches or that we judge harmful to individuals or COYS or any of our affiliates, licensors or partners.
o 6.3 We reserve the right to take whatever action we deem necessary to prevent such breaches including the following:
6.3.1 breaches we deem minor may result simply in receipt of a warning from the Moderating Team; or
6.3.2 breaches we deem serious may result in your automatic ban (whether temporary or permanent) from posting in the BNL or from the site itself.
6.3.3 All incidents will be logged and our decision is final in all such cases.
o 6.4 Any breaches may lead to us reporting your activities to your internet service provider, your employer, relevant authorities, or to legal action being taken against you, or both. We reserve the right to disclose your name and any other personal details of any user to any law enforcement authority or other competent authority or to any person for the purpose of legal proceedings or prosecution or investigation of any breach or alleged breach of this Agreement.
o 6.5 In addition we may at any time move, modify or remove any Content or take further legal action as a result of breaches or suspected breaches of these rules, our privacy policy, any applicable laws or regulations or where our rights or third party rights are threatened or infringed.

• 7 Rights of Access
o 7.1 You agree that your access to COYS is a privilege and not a right, and your ‘access rights’ are revocable at any time as set out elsewhere in these rules. Notwithstanding any donation that you may make to COYS (which we undertake to use as we determine most appropriate to enhance, prolong or enable access to COYS) or other contribution to this website you have no right under these rules or otherwise to access or use this website.
o 7.2 You further agree that any donation or other contribution to this website will be a gift for no consideration and will not give rise to any contractual right to use or access this website nor vary the exclusion of liability pursuant to paragraph 3.2 above.
o 7.3 Your username, password and access rights are personal to you. You agree not to allow any other person to use your access/account information to access COYS. Further, you agree to take full responsibility for the actions of any person to whom you wittingly or unwittingly give access, and (notwithstanding and without prejudice to the indemnity in paragraph 5) for any harm caused to any minor who accesses the website using your access/account information.
